Terms of service

PAYMENT TERMS

A project is confirmed upon receipt of a 50% booking fee from the quoted total. This amount is due no later than 24 hours prior to the first day of shooting. The remaining amount of 50% is due upon delivery of files.

Copyright

Definitions:

Completed Media means any and all video and photography files supplied to The Client by Toast Creative. Media means any and all digital or analogue video, film, derivative images, computer generated images and photographs produced by Toast Creative; RAW Files means the original and unedited Media recorded during the provision of the Services.

Terms of use:

Toast Creative grants a non-exclusive licence to The Client to:

Display or publish the Completed Media through any medium for
commercial purposes.

The licence granted to the Client does not allow the Client to:
Sell any Completed Media or electronic file supplied by Toast Creative; Make derivative works, or otherwise modify, edit or manipulate the Completed Media except within the context of the originally intended purpose of the media.

The Client acknowledges and agrees that all RAW Files, Media, Completed Media and copyrights created or existing (whether before or after the date of this Contract) in connection with the provision of the Services are the property of Toast Creative. Toast Creative may use, display and/or publish any images and/or video at their discretion for marketing, advertising and/or competition purposes.

Re-orders

All re-orders are to be considered an extension of this contract

Prices

All prices mentioned are in $NZD.

Delivery

The first draft shall be delivered as agreed. Final material will be delivered via Google Drive unless otherwise agreed.

Editing + Changes

Toast Creative retains the right to edit the video as they see fit based on our experience and expertise and based upon our style as evident in our published work. We may also omit any footage that does not meet our standards. We will allow for included changes as outlined in the Brief. Any additional revision rounds may be subject to additional costs, which will be communicated to the Client before any non-included revisions are started.

Music

Toast Creative will use standard licensed music included in the price outlined in the Brief. If the Client has specific requirements that fall outside of our standard music options, this will be negotiated on a case by case basis and may incur additional licensing costs.

Drone

Aerial video (if contracted) is subject to suitable weather conditions and locations.
